BlueIxia Intelligence terms

BlueIxia Intelligence is an authenticated environment made available to client organisations. Access is granted per organisation, and each organisation's records are visible only to that organisation and to authorised BlueIxia personnel.

These terms apply in addition to the Terms of Use, the Acceptable Use Policy and the Privacy Notice.

BlueIxia Intelligence provides:

• commercial analysis and payment intelligence
• data organisation and record management
• decision support and indicative analysis
• research and comparison of commercial options

It does not provide regulated financial, investment, legal or tax advice, and it does not perform underwriting.

Outputs may be derived from user-supplied data, third-party data, historical information, assumptions, calculations, analytical models and automated systems.

Users remain responsible for their commercial decisions. No output is a substitute for provider underwriting, a formal provider quotation, professional advice or independent due diligence.

Affirmative acceptance of these terms and acknowledgement of the Privacy Notice are required before an account is created. Acceptance is not pre-selected.

BlueIxia records the version of the terms accepted, the account and user concerned, and the date and time of acceptance.

Where these terms are materially revised, renewed acceptance may be required before continued use.

Credentials are personal to the individual to whom they are issued and must not be shared. The client organisation is responsible for the acts and omissions of its authorised users.

You must notify us promptly of any suspected unauthorised access.

Before uploading a merchant statement or other confidential document, the user must confirm that they are authorised to provide it and that BlueIxia may process it to provide the requested analysis.

Uploaded documents are held in restricted storage and are not published. They may be processed by service providers engaged to operate the service, subject to applicable data-protection obligations and contractual safeguards.

BlueIxia does not promise absolute confidentiality beyond the operational controls described in the Security Statement and the commitments given in the applicable contract.

BlueIxia retains all intellectual property rights in BlueIxia Intelligence, Q, their interfaces, methodologies, models, calculations, reports and data visualisations. The client receives a limited, non-exclusive, non-transferable right to use the service for its internal business purposes for the duration of its access.

Extraction of proprietary data, reverse engineering, benchmarking for a competing service, and use of BlueIxia outputs to train or develop a competing system are prohibited.

We may suspend access where reasonably necessary for security, suspected misuse, maintenance, legal requirements, risk, fraud prevention or breach of these terms.

Service levels, where offered, are set out in the applicable client agreement rather than in these terms.

To the fullest extent permitted by applicable law, and subject to liabilities that cannot lawfully be excluded, BlueIxia is not liable for loss of profit, revenue, business, opportunity, anticipated savings, goodwill or reputation, for business interruption, or for indirect, consequential or special loss arising from use of BlueIxia Intelligence.

Nothing in these terms excludes or limits liability for fraud, for fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that applicable law does not permit to be excluded or restricted.

Financial caps on liability for a paid service are set out in the applicable client agreement.

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where a signed client agreement specifies otherwise for the service it covers.
